Bail Link LLC ("BailLink," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you use the BailLink platform at baillinkusa.com and its tenant subdomains (the "Service").
This policy is written for a U.S. audience and applies to U.S. users.
1. Our Role: Controller vs. Processor
BailLink operates in two distinct roles depending on the data involved:
- Controller. For information collected about Agency Customers (the bail bond agencies that subscribe to our software) and for visitors to our public website, BailLink is the data controller.
- Service Provider / Processor. For information submitted by or about bond parties (indemnitors, defendants, and other individuals served by an Agency Customer), the Agency Customer is the controller and BailLink processes that information on the Agency Customer's behalf, in accordance with our agreement with that agency.
If you are a bond party and want to know how your information is used by a specific agency, contact that agency directly. You may also contact us at the addresses below and we will route your request appropriately.
2. Information We Collect
2.1 Agency Account Information
When an agency signs up and uses the Service, we collect:
- Business name, address, phone number, and email
- License and registration information
- Authorized user names, work email addresses, and role
- Authentication identifiers and session metadata
- Billing contact and transaction history (card data itself is processed by our payment processor, not stored by BailLink)
2.2 Bond-Party Information (Processed on Behalf of an Agency)
When an Agency Customer uses the Service to bond a defendant or onboard an indemnitor, the following information may be submitted to the Service:
- Full name, date of birth, and contact information
- Social Security number (encrypted at rest)
- Driver's license or state-ID number and, optionally, uploaded ID images
- Address, employer, and references
- Signature images captured electronically
- Bond details (amount, charges, court information)
- Payment metadata such as transaction IDs and amounts
2.3 Payment Information
Card and bank-account numbers are collected and processed by our payment processor (Stripe). BailLink does not store full credit-card or bank-account numbers on our servers. We retain transaction metadata such as Stripe identifiers, amounts, and status.
2.4 Technical and Log Information
We collect technical data automatically, including IP address, device and browser information, referring/exit pages, timestamps, magic-link redemption events, audit-log events, and webhook delivery records.
2.5 Cookies and Similar Technologies
We use a limited set of cookies and similar technologies for authentication, session management, security, load balancing, rate limiting, bot protection, error monitoring, and (with your consent where required) analytics and marketing measurement. See Section 9 below.
2.6 Public Directory Information
Our public bondsman directory uses public-record-style business listing data (agency name, license, address, service area, public contact). It does not include bond-party personal information.
3. How We Use Information
We use information to:
- Provide, secure, maintain, and support the Service
- Authenticate users and protect accounts
- Process subscription fees and platform application fees
- Facilitate communications between Agency Customers and bond parties (email, SMS, document signing, court reminders)
- Generate and deliver legal documents (applications, indemnity agreements, receipts)
- Detect, prevent, and respond to fraud, abuse, security incidents, and policy violations
- Comply with legal obligations, court orders, and lawful requests
- Improve and develop new features (using aggregated or de-identified data where feasible)
- Send transactional notices, and—where permitted—Service updates
We do not sell personal information. We do not use bond-party information for cross-context behavioral advertising.
4. Legal Bases (Plain-Language Summary)
We process information because it is necessary to deliver a service you (or your agency) requested, to fulfill our contractual obligations, to comply with the law, to protect our legitimate interests in operating and securing the Service, and—where required—based on your consent (for example, marketing email, optional analytics cookies, and SMS).
5. How We Share Information
We share information only as described below:
5.1 With the Agency Customer
Bond-party information is shared with the Agency Customer that initiated the bond workflow. Agency Customers control their own data within the Service and are responsible for how they use it.
5.2 With Service Providers (Subprocessors)
We use vetted third-party providers to operate the Service. Each is bound by confidentiality and data-protection obligations and is used only to provide functionality on our behalf. Current categories include:
- Identity and authentication: Account login and session management for agency users.
- Database and file storage: Encrypted Postgres database and private file storage.
- Payment processing: Card and bank payments, payouts to agencies (Stripe — a PCI Level 1 Service Provider).
- Transactional email: Account, magic-link, document, and notification emails.
- SMS messaging: Magic links, court reminders, and transactional alerts via carrier-registered 10DLC.
- Mapping / geocoding: Public bondsman directory map.
- Background job processing: PDF generation and asynchronous workflows.
- Rate limiting and caching: Abuse prevention on public endpoints.
- Error monitoring: Application error tracking.
- Hosting and CDN: Application hosting and content delivery.
- Bot protection: Automated-traffic prevention on public forms.

5.3 SMS Privacy Notice
If you provide your mobile phone number, BailLink may use it to send transactional and informational SMS messages related to your bond package, document signing, payment status, court reminders, secure access links, and service-related updates.
BailLink does not sell, rent, or share mobile phone numbers, SMS opt-in data, or SMS consent information with third parties for their marketing or promotional purposes. SMS information may be shared only with service providers, messaging carriers, and technology vendors as necessary to deliver text messages, operate the Service, comply with law, or protect the security of the platform.
Message frequency may vary. Message and data rates may apply. You may reply STOP to unsubscribe or HELP for assistance.
5.4 For Legal Reasons
We may disclose information if required by law, subpoena, court order, or government request; to enforce our Terms; to investigate fraud or security incidents; or to protect the rights, property, or safety of BailLink, our users, or the public.
5.5 In a Business Transfer
If BailLink is involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred, subject to this Privacy Policy or a notice of any material change.
5.6 With Your Direction
We share information at your direction or with your consent.
6. Data Retention
We retain information for as long as needed to provide the Service, to comply with legal obligations (including state bail-industry recordkeeping requirements that may apply to Agency Customers), to resolve disputes, and to enforce agreements. Bond-party data is retained according to the Agency Customer's configuration and applicable law. Encrypted backups follow standard retention windows and are overwritten on a rolling basis.
7. Security
We use administrative, technical, and organizational measures designed to protect personal information, including:
- Encryption in transit (TLS) and at rest for sensitive fields such as Social Security numbers
- Private file storage with short-lived signed download URLs (approximately 10 minutes)
- Tenant isolation enforced at the database level (row-level security)
- Rate limiting on public and signing endpoints
- Single-use, time-limited, IP-bound magic links
- Operational logging that excludes full SSNs, full dates of birth, signature images, and uploaded ID images
- Vendor selection focused on SOC 2-compliant infrastructure providers and security-focused vendors
- Periodic review of access, secrets, and configurations
No method of transmission or storage is 100% secure. We cannot guarantee absolute security, but we work hard to protect information and to respond promptly to suspected incidents.

8. Your Choices and Rights
8.1 Access, Correction, Deletion
If you are an Agency Customer user, you may access and update your account information from within the Service. If you are a bond party, contact the agency that sent you a link, or contact us and we will route your request.
Depending on your state of residence (e.g., California, Colorado, Connecticut, Virginia, and other U.S. states with consumer-privacy laws), you may have rights to:
- Confirm whether we process personal information about you
- Access a copy of that information
- Request correction of inaccurate information
- Request deletion (subject to legal exceptions, such as recordkeeping requirements)
- Opt out of "sale" or "sharing" for cross-context behavioral advertising (we do not sell personal information and do not engage in such sharing for bond-party data)
- Limit use of sensitive personal information (e.g., SSN) to providing the Service
To exercise rights, email info@baillinkusa.com with the subject line "Privacy Request." We may need to verify your identity. We will not discriminate against you for exercising your rights.
8.2 Marketing Opt-Out
You may opt out of marketing emails by clicking the unsubscribe link in any marketing email. Transactional messages cannot be opted out of while you remain an active user.
8.3 SMS Opt-Out
Reply STOP to any text message to unsubscribe. Reply HELP for assistance. Message frequency may vary, and message and data rates may apply.
8.4 Authorized Agents
You may use an authorized agent to submit a request on your behalf. We may require verification.
9. Cookies, Analytics, and Advertising
9.1 Strictly Necessary
We use cookies necessary for authentication, security, fraud prevention, and load balancing. These cannot be disabled through our consent banner because the Service will not function without them.
9.2 Analytics
With your consent (where required by your state's law), we may use analytics tools such as Google Analytics to understand aggregate usage. Analytics data is used to improve the Service and is not used to identify you personally.
9.3 Advertising Pixels
Our public marketing pages may use measurement pixels such as the Meta (Facebook) Pixel and similar tools to measure the effectiveness of advertising. These are loaded only after you provide consent via our cookie banner. You may withdraw consent at any time by re-opening the cookie preferences and adjusting your settings. We do not deploy advertising pixels on tenant subdomains or pages used by bond parties for document signing or payment.
9.4 Do Not Track / Global Privacy Control
Our website honors recognized opt-out preference signals (such as Global Privacy Control) as an opt-out of optional analytics and advertising cookies where applicable law requires.
10. Children's Privacy
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact info@baillinkusa.com and we will delete it.
11. International Users
The Service is operated in the United States and intended for use within the United States. If you access the Service from outside the U.S., you understand that your information will be transferred to, stored, and processed in the United States.
12. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated through the Service or by email. The "Last Updated" date at the top reflects the most recent revision.
